Terms of Service

These terms are an agreement between you and Pedagogix, Inc. (“Pedagogix,” “we,” “us”). They apply when you use our websites, Pedagogix OS, Pedagogix SIMS, or SIMS Fit. When you create an account or first sign in, we ask you to agree to them. If you use Pedagogix for an institution or company, you agree on its behalf, and “you” means that organization.

Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.

The services

Pedagogix provides the Pedagogix OS teaching platform, Pedagogix SIMS (our catalog of business simulations), SIMS Fit (which suggests where a simulation fits in a course), and this website. Some services are sold to institutions; some can be bought by individual instructors.

Accounts

  • You’re responsible for keeping your login secure and for what happens under your account. Don’t share it. Tell us right away if you think someone is using it without permission.
  • Accounts created for others. An instructor or institution can create accounts for students or colleagues. If you do, you confirm you have the authority to do so and to share the information you enter. Each person agrees to these terms when they first sign in.
  • Who can use Pedagogix SIMS. Pedagogix SIMS is designed for higher education, executive education and workplace training. Users must be at least 18, or use it through a school that has authorized their use.
  • Sign in to the product you use: app.pedagogix.ai (Higher-Ed), k12.pedagogix.ai (K-12), or sims.pedagogix.ai (Pedagogix SIMS).

Purchases, seats, and renewals

  • Pedagogix SIMS is priced per participant (a “seat”). Each seat is one full, scored play of a simulation. Seats can be bought self-serve or by institutional quote. Payments are handled by Stripe.
  • One-time seats are paid once and don’t expire. There’s nothing to cancel.
  • Subscriptions, where offered, renew for another term unless you cancel before the renewal date. Before any charge we show the price, what renews and when, and how to cancel.
  • Pedagogix OS is an institutional subscription, priced per enrolled student per year and arranged by quote.
  • All sales are final. Because you can try the simulations with free seats before buying, we don’t give refunds for self-serve purchases, including seats you haven’t used, except where the law requires it. Seats are available as soon as payment goes through, and by buying you ask us to provide them right away.
  • Institutional and enterprise purchases are made under a separate written agreement or order. Its terms on pricing, payment, refunds, and data control over these terms where they differ. Everyone still signs in the same way and agrees to these terms at sign-in.
  • Prices don’t include taxes unless we say so.

Free trial and educator pricing

Instructors can try the simulations free, with a limited number of free seats across the catalog, before buying. Educator pricing is for people who teach. We confirm teaching status from the institution in your email address and public sources such as your institution’s faculty directory, and we may ask you for more information. Educator pricing applies only once teaching status is confirmed.

AI features

  • Our products, including Pedagogix OS (Higher-Ed and K-12), Pedagogix SIMS, and SIMS Fit, use artificial intelligence to draft, grade, tutor, analyze, and generate content, such as course materials, feedback, characters’ replies, debriefs, and placement plans. AI output can be wrong, incomplete, or unexpected. Review it before relying on it, and use your own judgment. It is not professional, legal, financial, or medical advice.
  • Instructors remain responsible for grades and teaching decisions. The service helps; it doesn’t decide for you.
  • To provide these features, we send the relevant content to third-party AI models and services, such as large language models, speech and voice, and other machine learning services, from providers we choose. The providers we use can change over time. They process the content on our behalf to provide the feature, under their own terms. Where an institution’s agreement with us limits which providers may process its data, we follow that agreement.
  • We don’t use your content or your students’ work to train AI models, and we don’t send information that identifies students or instructors to AI providers, apart from the exceptions in our Privacy Policy.

SIMS Fit

When you send course materials to SIMS Fit, you confirm you have the right to share them with us for this purpose. Don’t include student records or other personal information about students. The plan you receive is a recommendation to help you decide, not a guarantee of fit or results. How we store and delete your materials is set out in the Privacy Policy.

Acceptable use

Don’t misuse the products. In particular, don’t:

  • break the law, infringe anyone’s rights, or harass other users;
  • try to disrupt, overload, or reverse-engineer the service, or gain access you’re not entitled to;
  • use bots, scripts, or other automated means to play simulations, collect content, or alter scores;
  • share answers, accounts, or seats in ways your instructor or institution hasn’t allowed;
  • try to make the AI characters or features produce harmful, abusive, or unlawful content, or get around their safeguards;
  • use the simulations for graded work in ways your institution’s academic-integrity rules don’t allow;
  • upload harmful code, or use the service to build a competing product.

Use student data only as your institution and applicable law permit.

Intellectual property

Pedagogix and its licensors own the products, the simulations, and the related content and technology, including the work described on our patents page. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription or license, or for the seats you’ve bought. Content you or your students create stays yours (or your institution’s); you give us the rights we need to operate the service. If you send us feedback or suggestions, we may use them without obligation to you.

Institutional and educational use

When an institution buys Pedagogix, the applicable order or agreement governs data handling and educational-records obligations, and controls if it conflicts with these terms.

Disclaimers

The service is provided “as is” and “as available.” We don’t guarantee it will be uninterrupted or error-free. The products are teaching and practice tools; they don’t replace professional judgment.

Limitation of liability

To the fullest extent the law allows, Pedagogix isn’t liable for indirect, incidental, special, or consequential damages, or for lost profits or data, and our total liability is limited to what you paid us for the service in the 12 months before the claim.

Indemnification

To the extent the law allows, you agree to cover claims that arise from your misuse of the service or your violation of these terms.

Termination

You can stop using the service anytime. We may suspend or end access if you break these terms, or as needed to protect the service or its users. When access ends, the parts of these terms that by their nature should continue, such as ownership, disclaimers, and limits of liability, continue.

Changes to these terms

We may update these terms. When we make a material change, we’ll update the date above and ask you to agree to the new version the next time you sign in. If you don’t agree, you can stop using the service.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wisconsin, and both parties consent to their jurisdiction.
