Terms of Service

These terms are an agreement between you and Pedagogix. By using our websites or products, you agree to them. If you’re using Pedagogix for an institution or company, you’re agreeing on its behalf, and “you” means that organization.
The services
Pedagogix provides the Pedagogix OS teaching platform and Pedagogix SIMS, our catalog of simulations, along with this website. Some services are sold to institutions; some can be bought by individual instructors.
Accounts
You’re responsible for keeping your login secure and for what happens under your account. Tell us right away if you think someone’s using it without permission. Log in to the product you use, app.pedagogix.ai (Higher-Ed), k12.pedagogix.ai (K-12), or sims.pedagogix.ai (Pedagogix SIMS).
Purchases, subscriptions, and renewals
- Simulations on Pedagogix SIMS are priced per participant and can be bought self-serve or by institutional quote. Payments are handled by Stripe.
- Pedagogix OS is an institutional subscription, priced per enrolled student per year and arranged by quote.
- Subscriptions renew for another term unless you cancel before the renewal date. Before any charge, we show the price, the renewal date, and how to cancel. Fees are non-refundable except where the law requires or your order says otherwise.
Free trials and academic pricing
Instructors can try simulations free before buying. Discounted academic and regional pricing requires an eligibility check (through SheerID or a comparable service), and applies only where eligibility is confirmed.
Acceptable use
Don’t misuse the products. In particular, don’t break the law, infringe anyone’s rights, try to disrupt or reverse-engineer the service or gain access you’re not entitled to, upload harmful code, or use the service to build a competing product. Use student data only as your institution and applicable law permit.
Intellectual property
Pedagogix and its licensors own the products, the simulations, and the related content and technology, including the work described on our patents page. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription or license. Content you or your students create stays yours (or your institution’s); you give us the rights we need to operate the service.
Institutional and educational use
When an institution buys Pedagogix, the applicable order or agreement governs data handling and educational-records obligations, and controls if it conflicts with these terms.
Disclaimers
The service is provided “as is” and “as available.” We don’t guarantee it will be uninterrupted or error-free. The products are teaching and practice tools, they don’t replace professional judgment.
Limitation of liability
To the fullest extent the law allows, Pedagogix isn’t liable for indirect, incidental, or consequential damages, and our total liability is limited to what you paid us for the service in the 12 months before the claim.
Indemnification
To the extent the law allows, you agree to cover claims that arise from your misuse of the service or your violation of these terms.
Termination
You can stop using the service anytime. We may suspend or end access if you break these terms, or as needed to protect the service or its users.
Changes to these terms
We may update these terms. When we make a material change, we’ll update the date above and, where it makes sense, let you know. Continuing to use the service means you accept the updated terms.
Governing law
These terms are governed by the laws of the United States and the state in which Pedagogix is incorporated, without regard to conflict-of-law rules.
